Warranty
Effective Date: Date of Delivery to Original Purchaser
Applies To: All HydroSpring® brand hot tubs sold at retail by Hot Tub & Sauna Depot (“Dealer”).
This Limited Warranty is a legally binding agreement between the Original Purchaser and Hot Tub & Sauna Depot. By accepting delivery, operating, or requesting service for the Product, the Original Purchaser agrees to all terms and conditions set out below, subject to rights that cannot be excluded under applicable law.
1. DEFINITIONS
1.1 “Dealer” means Hot Tub & Sauna Depot.
1.2 “Manufacturer” means HydroSpring Spas.
1.3 “Product” means any HydroSpring® hot tub and its factory-installed components purchased from Dealer.
1.4 “Original Purchaser” means the first retail purchaser taking delivery of the Product.
1.5 “Normal Residential Use” means private residential use in accordance with the Manufacturer’s owner’s manual.
1.6 “Authorized Service Provider” means a service technician authorized by the Dealer and/or Manufacturer.
2. MANUFACTURER WARRANTY REFERENCE
This Limited Warranty incorporates and aligns with the HydroSpring manufacturer warranty as published at:
Where terms differ, the Manufacturer’s final determination regarding component eligibility shall prevail.
3. WARRANTY COVERAGE PERIODS (INDUSTRY STANDARD)
Subject to the terms, exclusions, and limitations contained herein, coverage applies as follows:
Spa Structural Shell: 5 years
Shell Surface: 3 years
Standard Equipment (pumps, heater, controls, plumbing): 2 years
Optional Components: 1 year
Cabinet: 2 years
Cover: 1 year
Steps, Bar Table, Bar Stool: 1 year
Coverage applies only to defects in materials or workmanship under Normal Residential Use.
4. WARRANTY ACTIVATION & NON-TRANSFERABILITY
4.1 Warranty coverage begins on the date of delivery to the Original Purchaser.
4.2 Warranty registration is completed by the Dealer at time of sale.
4.3 This warranty is non-transferable and terminates upon resale, transfer, rental, or change of ownership.
5. OWNER RESPONSIBILITIES (CONDITIONS OF COVERAGE)
The Owner is responsible for:
*Maintaining proper water level at all times
*Maintaining balanced water chemistry
*Providing continuous electrical power, especially during freezing temperatures
*Following all Manufacturer and Dealer operating, filling, draining, and winter operation instructions
*Responding immediately to error codes, warnings, or circulation issues
*Failure to meet these responsibilities may void warranty coverage.
6. WHAT VOIDS WARRANTY COVERAGE
Warranty coverage is void for damage resulting from, including but not limited to:
*Freeze damage (subject only to Section 7 below)
*Draining or partial draining during freezing conditions
*Improper filling or air locks
*Negligence, misuse, or abuse
*Unauthorized repairs or modifications
Improper installation or non-compliant electrical supply
*Acts of nature or environmental exposure
7. FREEZE DAMAGE — EXCLUSION WITH LIMITED EXCEPTION
7.1 GENERAL RULE (NOT COVERED)
**Freeze damage of any kind is not covered under warranty.
Freeze damage commonly occurs due to:
-Power loss during freezing temperatures
-Low or improper water level
-Draining or refilling during winter
-Cold-water start-ups where heater cannot engage
-Improper winterization
-Air locks caused by improper filling
-Ignoring error codes or circulation failures
7.2 LIMITED EXCEPTION (RARE CIRCUMSTANCES)
Damage is proven to be caused solely by a manufacturing defect.
7.3 BURDEN OF PROOF
The burden of proof rests entirely with the Owner. All determinations regarding freeze damage are final, subject only to non-excludable rights under law.
8. IMPROPER FILLING & AIR LOCKS
Improper filling — including filling without using the filter housing — can cause air locks, loss of circulation, heater damage, and freeze damage.
Damage caused by improper filling or air locks is not covered under warranty.
9. EXCLUSIONS & LIMITATIONS
This warranty does not cover:
*Normal wear and tear
*Cosmetic damage after installation
*Chemical damage due to improper water balance
*Improper site conditions or base support
*Unauthorized service or third-party repairs
10. WARRANTY SERVICE PROCEDURE
All warranty service must be initiated through Hot Tub & Sauna Depot. Proof of purchase and maintenance records may be required. Unauthorized service voids coverage.
11. SERVICE CALLS & LABOR
Labor is covered only where explicitly authorized. Non-warranty service calls are billable from the time technicians depart the Dealer location.
12. IMPLIED WARRANTIES & LEGAL RIGHTS
This Limited Warranty is provided in addition to rights available under applicable provincial and federal law.
In Newfoundland and Labrador, implied conditions under the Sales of Goods Act and consumer protection legislation may apply to the extent they cannot be excluded.
Nothing in this warranty limits rights that cannot lawfully be waived.
13. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Dealer and Manufacturer shall not be liable for incidental, indirect, special, or consequential damages, including loss of use or enjoyment.
14. GOVERNING LAW
This warranty is governed by the laws of the Province of Newfoundland and Labrador and the applicable laws of Canada.
15. ENTIRE AGREEMENT & SEVERABILITY
This document, together with the referenced Manufacturer warranty, constitutes the entire warranty agreement.
If any provision is deemed unenforceable, the remaining provisions remain in full force and effect.
16. CUSTOMER ACKNOWLEDGEMENT
By accepting delivery of the Product, the Original Purchaser acknowledges having read, understood, and agreed to this Limited Warranty.
